By engaging with the Apex Zone website or services, you agree to comply with and be bound by the following terms and conditions. Please review them carefully.
1. Scope of Services
Apex Zone provides premium web design, full-stack development, and SEO marketing services. Specific project scopes, timelines, and deliverables are governed by individual client agreements signed prior to project commencement.
2. Intellectual Property
All creative works, code architectures, and visual designs produced by Apex Zone remain the intellectual property of the agency until full payment is received, upon which rights are transferred as per the project contract.
3. Professional Liability
While we strive for digital perfection, Apex Zone is not liable for indirect losses or third-party platform changes (e.g., Google algorithm updates) beyond our reasonable control.
4. Jurisdiction
These terms are governed by the laws of the State of New York. Any disputes shall be resolved through arbitration within the jurisdiction of New York County.
5. Regulated Industry Clients & No Professional Advice
Apex Zone provides website design, development, and SEO/GEO marketing services. We are not a law firm, financial advisory firm, healthcare provider, or educational institution, and nothing we build, write, or recommend constitutes legal, financial, medical, or educational advice. For clients in legal, financial services, healthcare, or education, final responsibility for ensuring published content complies with applicable industry regulations (including attorney advertising rules, FINRA/SEC marketing requirements, HIPAA, FERPA, and Fair Housing Act requirements) rests with the client and their own licensed professionals or compliance counsel prior to publication.
6. Accessibility
Apex Zone makes reasonable efforts to design websites consistent with Web Content Accessibility Guidelines (WCAG) 2.1 Level AA where specified in a project's scope. Accessibility compliance is an ongoing process; we do not warrant that any deliverable is fully compliant with the Americans with Disabilities Act (ADA) or equivalent state law, and clients are encouraged to conduct independent accessibility audits for their published sites.
7. No Guaranteed Marketing Results
While Apex Zone uses data-driven SEO and Generative Engine Optimization (GEO) practices, we do not guarantee specific search rankings, traffic levels, or citation by AI assistants, as these outcomes depend on factors outside our control, including third-party algorithm changes. Any performance figures referenced in our marketing materials are illustrative and not a warranty of results for any individual client.
